Section 50 NDPS Act is satisfied when the accused is given the option of being searched in presence of a Gazetted Officer or Magistrate; presence of a Gazetted Officer who arrived after detention is sufficient and does not vitiate compliance, even if the officer was part of or accompanying the raiding party. The High Court erred in presuming bias and holding search invalid under Section 50; the conviction and sentence of the accused are restored.
