Procedural Posture

Civil Appeal / Appeal by Special Leave From the Judgment and Order Dated the 6th October, 1956, of the Industrial Tribunal, Bombay, in Reference (i. T.) Nos. 40 & 44 of 1956.

  1. 1 Whether the Industrial Tribunal was bound to apply the Full Bench formula for calculation of bonus.
  2. 2 Whether the employer's claim for rehabilitation must be allowed under the formula.
  3. 3 Whether previous rehabilitation allowances and prevailing price levels were correctly considered.

Ratio Decidendi

The Tribunal was in error in failing to apply the Full Bench formula and not allowing the appellant's claim for rehabilitation. On the Tribunal's own alternative calculations, when rehabilitation is allowed, there is no available surplus for bonus. The methods adopted for calculation, including the weighted average for asset life, are accurate and justified by the evidence. Therefore, no further bonus was payable, and the award for bonus must be set aside.

Court Disposition

Appeal allowed.
