Procedural Posture

Writ Petition (civil) / Miscellaneous Application No.2219 of 2020 Disposed (application for Continuation of Incumbent Chairperson Dismissed)

  1. 1 Whether the incumbent Chairperson of the Intellectual Property Appellate Board (IPAB) should continue in office until a new Chairperson is appointed
  2. 2 Whether Section 89A of the Trade Marks Act and Section 184 of the Finance Act, 2017 govern tenure and age limits so as to extend the incumbent’s term
  3. 3 Whether the Board can function in the absence of a judicial member and whether technical members can act as Chairperson or constitute benches

Ratio Decidendi

The incumbent’s appointment terms (as amended) and the 2017 Rules fixed his tenure ending on 21.09.2019; that period had expired before the 2017 Rules were struck down on 13.11.2019, and Section 184 furnishes outer limits rather than automatically extending existing tenures; consequently continuation could not be ordered. Further, statutory provisions (Sections 84(3), 85 and 87) permit bench functioning and appointment/acting as Chairperson by members who are legally qualified technical members, so the Board can function without extending the incumbent’s tenure.
