Assistant Public Prosecutors and Public Prosecutors are appointed under different mechanisms, governed by distinct service conditions. Assistant Public Prosecutors appointed prior to 31st March, 2013 are entitled to statutory pension and retire at 56 years, while those appointed after 1st April, 2013 retire at 60 years under the new Contributory Pension Scheme. Parity in retirement age cannot be claimed based only on similarity of functions. Accepting alternative plea of foregone pension would cause inconsistency and discrimination within government employees. Policy decisions are best left to the State Government.
