Procedural Posture

Civil Appeal / Appeal From Patna High Court Judgment Dated 28.10.2016

  1. 1 Whether a Meritorious Reserved Candidate (MRC) can opt for a seat earmarked for reserved category in medical admissions
  2. 2 What happens to the general category seat vacated by MRC opting for reserved category seat

Ratio Decidendi

A Meritorious Reserved Candidate (MRC) is entitled to admission on merit and has the option to choose admission to a college where seats are reserved for the category. When an MRC opts for a reserved category seat, he is deemed admitted as an open category candidate and the aggregate reservation cap (50%) is not breached. The seat vacated by the MRC in general category is filled by the affected reserved category candidate; the percentage of reservation remains undisturbed.
