Ratio Decidendi

When promotees are continuously appointed to permanent posts and the direct recruitment quota is not maintained, seniority must be fixed with reference to the length of continuous service from the date of appointment as Divisional Medical Officer. Zone-wise confirmation and post-hoc application of quotas and rotation are not permissible. The impugned seniority list and consequential promotions made thereunder are invalid; a fresh seniority list must be drawn up on the correct legal principles.
