The exemption notification under the proviso to Section 47 of the Persons with Disabilities Act, 1995 applies to the entire section, not just sub-section (2). CRPF is exempted from the rigours of Section 47, including dispensing with service and reduction in rank, because Section 47 is the leading substantive provision and Section 73 is merely a machinery provision. A proviso does not travel beyond the section it qualifies, and the relevant date for exemption is the date of service dispensing, not disability occurrence. Exemption is not discriminatory as it is based on rational classification relating to the type of work carried out in the establishment.
