Clause 18 of the General Conditions of Contract allows recovery and appropriation only for sums presently due and payable; a claim for damages—even if stipulated as liquidated damages—does not constitute a debt until adjudicated, and therefore appellant cannot appropriate amounts due under other contracts toward its unadjudicated damages claim. The interim injunction issued by the High Court is within its powers under s.41(b) of the Arbitration Act.
