Legal Issues
- 1 Whether Meritorious Reserved Category (MRC) candidates selected on merit and placed in the list of General Category candidates could be considered as Reserved Category candidates at the time of service allocation
- 2 Whether Rules 16(2), (3), (4), and (5) of the Civil Services Examination (CSE) Rules are inconsistent with Rule 16(1) and violative of Articles 14, 16(4), and 335 of the Constitution of India
- 3 Whether the order of the Central Administrative Tribunal was valid to the extent that it relied on Anurag Patel v. UP Public Service Commission and Ritesh R. Sah v. Dr. Y.L. Yamul, and whether principles relating to reservations for admissions can be applied to service reservations
Ratio Decidendi
Reserved category candidates (OBC, SC/ST) who qualify on merit and are placed in the general category list may choose to migrate to their respective reserved category at the time of service allocation without violating Rule 16(1), Articles 14, 16(4), or 335. The seat vacated by such MRC candidates in the general pool is offered to general category candidates to ensure aggregate reservation does not exceed 50%. Rule 16(2) is valid, constitutionally compliant, and preserves the reserved status and preferred service allocation for MRC candidates.
Court Disposition
appeal allowed
Orders
- Judgment of the Madras High Court is set aside
- Writ petitions challenging Rule 16(2) are dismissed
