Ratio Decidendi

Reserved category candidates (OBC, SC/ST) who qualify on merit and are placed in the general category list may choose to migrate to their respective reserved category at the time of service allocation without violating Rule 16(1), Articles 14, 16(4), or 335. The seat vacated by such MRC candidates in the general pool is offered to general category candidates to ensure aggregate reservation does not exceed 50%. Rule 16(2) is valid, constitutionally compliant, and preserves the reserved status and preferred service allocation for MRC candidates.
