Ratio Decidendi

The respondent’s termination was in violation of Section 6-N of the U.P. Industrial Disputes Act as he had rendered 240 days of continuous service. However, full and automatic award of back wages is not warranted without proof of unemployment or exceptional circumstances. Since the appellant's undertaking was closed and there was no plea by the respondent of being unemployed, interest of justice is served by awarding only 25% of back wages from the date of termination until closure of the establishment, along with compensation under Section 6-N.
