Persona Digital Telephony Ltd. & Anor v Minister for Public Enterprise & Ors [2019] IECA 360 (16 December 2019)
Amendments particularising the corruption claim and those arising from the same factual matrix are permitted, as they are necessary to determine the real questions in controversy and do not cause real prejudice. Amendments introducing claims of ordinary procurement errors or process irregularities not linked to the original corruption claim are not permitted, as they constitute new causes of action outside the scope of the original proceedings and would be statute-barred. The claim for unjust enrichment and account of profits against the fourth defendant is allowed, as it arises from the same core allegation of corrupt misconduct and is sufficiently pleaded.
