Maguire -v- Governor of Mounjoy Prison (The Dochas Centre)... [2017] IECA 142 (04 July 2017)
A Circuit Court judge is empowered to strike out or affirm a District Court order on appeal if the appellant fails to appear, without a full rehearing. There is no requirement for the committal warrant to recite consideration of community service, and technical errors on the warrant do not invalidate it unless they affect jurisdiction or cause injustice.

Legal Issues
- 1 Whether a Circuit Court must conduct a full rehearing on appeal from the District Court if the appellant fails to appear or prosecute the appeal
- 2 Whether a committal warrant is invalid if it omits reference to consideration of a Community Service Order under s.3 of the Criminal Justice (Community Service) (Amendment) Act 2011
- 3 Whether technical errors on the face of a committal warrant (e.g., reference to a 'hearing' where none occurred) invalidate the warrant and detention
Ratio Decidendi
A Circuit Court judge is empowered to strike out or affirm a District Court order on appeal if the appellant fails to appear, without a full rehearing. There is no requirement for the committal warrant to recite consideration of community service, and technical errors on the warrant do not invalidate it unless they affect jurisdiction or cause injustice.
Court Disposition
Allow Brennan appeal, dismiss remainder
Orders
- Appeal allowed in Brennan case; committal warrant found valid despite technical error.
- Appeals dismissed in Maguire, Animashaun, Silaghi, and Marina cases; committal warrants upheld.
