Kenny & ors -v- Department of Justice Equality & Law Reform & ors [2014] IEHC 11 (13 January 2014)
The Labour Court erred in accepting the claimants' narrow choice of comparators; valid comparators must be drawn from the generality of Gardaí engaged in clerical duties. Objective justification must address the pay differential itself, not just operational deployment. Industrial relations may be considered but cannot be the sole justification. The matter is remitted to the Labour Court for rehearing in accordance with these principles.
