The Court found that the material before it did not establish compliance with Article 4a(1) of the Framework Decision, that the sentence appeared statute-barred, and that Mr Siklosi had effectively served virtually all of his prison sentence. The Court determined there was no good reason to seek further information or remit the proceedings, and allowed the appeal, discharged the order for surrender, and dismissed the proceedings.
