The Supreme Court held that there was no contempt of court as the authorities had no notice of the orders before deportation, habeas corpus jurisdiction ended once the applicants were outside the State and no longer detained, and the High Court had no jurisdiction to order their return in habeas corpus or contempt proceedings. The institution of judicial review proceedings does not automatically stay deportation; only a court order or interim injunction can do so. The appeals were allowed and the cross-appeals dismissed.
