O'Callaghan (A Bankrupt) [2015] IEHC 185 (27 March 2015)
The Court cannot consider the reasonableness of a creditor's refusal to accept a PIA when adjudicating a debtor bankrupt under s.15 of the Bankruptcy Act 1988, as amended. Since the PIA was not approved and no further PIA could be presented, the debtor's inability to meet his engagements could not more appropriately be dealt with by a PIA. The requirements for adjudication in bankruptcy were met and the order was appropriate.
