Dublin City Council -v- Fennell [2005] IESC 33 (12 May 2005)
The European Convention on Human Rights Act, 2003 does not apply retrospectively to proceedings issued or events occurring before its commencement. The Act is prospective in effect and does not alter the legal rights or obligations of parties in proceedings pending at the time of its coming into force. The Circuit Court, on appeal, must apply the law as it stood at the time the proceedings were initiated, not as amended by the 2003 Act.
