Gallagher v ACC Bank PLC [2012] IESC 35 (07 June 2012)
The Supreme Court held that the plaintiff suffered actual loss upon entering into the combined loan and investment transaction in 2003, as the product was inherently unsuitable and imposed an immediate financial burden. The cause of action in tort accrued at that point, not at the maturity of the bond. Therefore, the claim was statute-barred as proceedings were commenced more than six years later.
