It would not be a proper exercise of the court’s discretion under s. 216 of the Companies Act 1963 to adjourn the winding up petition and continue the provisional liquidator indefinitely for the purpose of finishing out contracts, as this is contrary to the statutory scheme and not justified by the circumstances of the company, which is hopelessly insolvent and lacks exceptional features warranting such an order.
