The explanations offered for the delay, including difficulties in obtaining legal representation and identifying defendants, were inadequate and did not excuse the delay. The balance of justice favored dismissal due to the prejudice to the defendants, including the risk of unfair trial, faded memories, and damage to professional reputation. The proceedings as constituted were also misconceived against certain defendants, and any amendment would be statute-barred. Accordingly, the applications to dismiss were granted.
