Ratio Decidendi

The statutory Garda Siochana (Discipline) Regulations, 1989 are complete and cannot be affected by the 1987 Memorandum of Agreement, which has no legal standing. The requirement for Ministerial consent in the Memorandum applies only to disciplinary matters arising from representative duties, not to all disciplinary proceedings. The applicant's breaches were unrelated to representative duties. Furthermore, the applicant failed to bring judicial review proceedings in a timely manner. No evidence was found that the Appeal Board considered irrelevant breaches.
