The Minister failed to provide detailed reasons for refusal as required by EC Directive 65/65 Article 12 and failed to ensure that Genmark had an opportunity to respond to all grounds for refusal, as the Minister relied on advice from the NDAB without independent evaluation or disclosure of all relevant information. This constituted a breach of natural and constitutional justice and of the Directive, warranting an order of certiorari quashing the Minister's decision.
