Bracken v. Byrne & Anor [2005] IEHC 80 (11 March 2005)
The court held that it was no longer reasonable to require the plaintiff to exercise her rights of residence, maintenance, and support due to the breakdown in relations, for which the preponderance of responsibility lay with the first named defendant. The plaintiff was therefore entitled to have those rights valued and paid in money. The alleged agreement for transfer of a site was not enforceable due to lack of consideration, absence of a memorandum, and insufficient detriment for proprietary estoppel.
