Dunne & Ors -v- Mahon & Anor [2012] IEHC 412 (10 October 2012)
The High Court has inherent jurisdiction to wind up an unincorporated association where a majority so desire, and absent express provision, rules may be amended by majority vote. However, Rule 37 is invalid as it deprives members of vested rights to share in assets on dissolution. Assets must be distributed equally among members unless valid rules provide otherwise.
