The High Court does not have jurisdiction to grant declaratory relief as to the meaning and scope of a planning permission in circumstances where the statutory code provides an exclusive procedure for such determinations by the planning authority and An Bord Pleanala under s.5 of the Planning and Development Act, 2000. To do so would create overlapping and unworkable jurisdictions contrary to legislative intent.
