A mortgagor who, for good consideration and with legal advice, enters into a settlement agreement expressly waiving all claims arising from the mortgage facilities and acknowledging the mortgagee's entitlement to possession, is precluded from relying on the Statute of Limitations to defeat the mortgagee's claim, even where statutory provisions purport to extinguish title. The statutory extinguishment operates only where the limitation defence is pleaded and not where it has been contractually waived or compromised.
