Ratio Decidendi

The injunction restraining the defendants from distributing information about abortion clinics outside the State was lawfully granted under the law prevailing at the time, but cannot be confirmed under current law due to the Fourteenth Amendment and the Regulation of Information Act, which now permit such information subject to statutory conditions. The previous Supreme Court decision in Open Door Counselling 1988 was erroneous and should not be followed.
