The trial judge's repeated characterisation of the defence as 'gentle consensual sex' versus rape, a term not used by the appellant, created a real risk of unfairness by undermining the defence in light of the evidence of injuries. The judge's subsequent directions did not adequately correct this, and the failure to sufficiently highlight independent evidence relevant to consent further contributed to the unfairness. Accordingly, the conviction was unsafe and must be quashed.
