The occupier of property is liable for the escape of fire caused by the negligence of an independent contractor, as such a fire is not accidental within the meaning of the Accidental Fires Act 1943. The statutory exemption does not apply to negligent fires, and the common law rule of strict liability remains in force in Ireland, unaffected by the general rule against vicarious liability for independent contractors in negligence cases.
