The absence of the Chief Internal Auditor from the disciplinary committee did not render the dismissal unfair because the 3rd respondent did not object at the time, suffered no prejudice, and pleaded guilty to the substantive charges. The arbitrator's award was based on a misinterpretation of the evidence and an overly legalistic approach. Even if there was procedural irregularity, reinstatement was not justified given the plea of guilt and broken trust.
