Procedural Posture

Civil Appeal / Judgment on Appeal

  1. 1 Whether police officers are entitled to a pre-transfer hearing before being transferred
  2. 2 Whether demotion was justified where failure to perform duties was due to a court-ordered stay of transfer
  3. 3 Whether the demotion constituted contempt of the court's stay order

Ratio Decidendi

The respondents were entitled to a prior hearing before being transferred; the absence of such a hearing rendered the transfers procedurally unfair and invalid. The demotion was not justified as it was based on inability to perform duties at posts to which transfer was stayed by court order. There was insufficient evidence of wilful and mala fide contempt by the Commissioner in effecting the demotion.

Court Disposition

Appeal partially allowed and partially dismissed.

Orders

  • The appeal against the contempt order succeeds; the order holding the Commissioner in contempt is set aside.
  • The demotion of the respondents is reviewed and set aside; no order as to costs in the contempt application.
