Ratio Decidendi

The court found that the NEC elected in January 2000, though its constitutional validity was questioned, was the de facto organ recognized at the material time and had convened the annual conference. The respondents and their followers did not have proper credentials and could not validly constitute themselves into a party conference or amend the constitution. The acts done in the hall were a nullity. The rule nisi was confirmed, and the applicants' locus standi was upheld. Points in limine were dismissed.
