Applicant acted in the position of Senior Inspector for more than 28 days and is entitled to the acting salary. Upon recall from secondment, applicant reverted to the substantive rank of Senior Inspector and is entitled to the corresponding salary. Respondents are estopped from denying the validity of the promotion as applicant relied on it in good faith and was not complicit in any procedural defect. The decision in the letter of 12th September 2017 is null and void.

Court Disposition

Application succeeds with costs.

Orders

  • Respondents to pay applicant’s salary for acting appointment from 31st January 2017 to 3rd March 2017.
  • Respondents to pay applicant the salary of the rank of Senior Inspector from June 2017 when recalled from NSS to date, excluding the period of secondment.
