Ratio Decidendi

The suspension of the Koro Koro Constituency Committee was invalid as it was imposed without a hearing, violating the audi alteram partem rule and was ultra vires the powers of the Executive Working Committee and NEC. The rejection of Professor Mahao's nomination was invalid due to conflict of interest among NEC members and lack of procedural fairness. Clause 5(e) of the ABC constitution is unconstitutional as it unjustifiably limits the right of access to courts and is contrary to constitutional values.
