The Agricultural Marketing (Egg Trading) Regulations 1973 were ultra vires the Minister's powers under the Agricultural Marketing Act 1967, as the Act did not authorize the creation of a marketing monopoly by subsidiary legislation. Consequently, the Applicants' claim to enforce the monopoly and compel the Minister to issue import permits failed. The Respondents' failure to consult the Applicants before issuing permits was procedurally improper but did not justify granting the substantive relief sought. Each party to bear its own costs.
