Ratio Decidendi

The identity of the Plaintiff was a material element of the contract. The First Defendant was misled into believing she was contracting with Kassim, not the Plaintiff. Kassim's failure to pay rent and vacating the premises constituted cancellation by conduct, entitling the First Defendant to sell the property to the Second Defendant. There was no evidence the Second Defendant knew of the prior sale. The Plaintiff's claim is dismissed.
