Legal Issues
- 1 Who is entitled to receive the terminal benefits of the late Bokang Michael Ntsihlele?
- 2 Does the widow lose succession rights due to non-attendance of the funeral?
- 3 Does nomination of next of kin on enlistment form override customary heirship?
Ratio Decidendi
The applicant, as the sole widow, is by Basotho custom the heiress to the estate of the late Bokang Michael Ntsihlele, and the terminal benefits form part of that estate. The first respondent's claim based on alleged wishes of the deceased and nomination of next of kin is not supported by law or evidence. Non-attendance at the funeral does not forfeit the widow's succession rights.
Court Disposition
