Procedural Posture

Judicial Review / Constitutional Petition / Judgment

  1. 1 Whether the Minister of Local Government had legal authority to dissolve the Maseru City Council Tender Board
  2. 2 Whether the Minister was required to afford the applicants a hearing before disbanding the Board
  3. 3 Whether the actions of the Council in passing a vote of no confidence against the Mayor were lawful

Ratio Decidendi

The Minister of Local Government had no legal authority to dissolve the Maseru City Council Tender Board, and his failure to afford the applicants a hearing before making a decision that adversely affected their status violated the principle of legality and natural justice. The purported justification of exigency was not pleaded or substantiated. The applicants' status as Board members was valid until lawfully terminated. The passing of a vote of no confidence against the Mayor was not a lawful basis for removal under the governing statute.
