The rule nisi was confirmed because the respondents and their followers did not have proper credentials to constitute themselves into a valid party conference under the party constitution. The NEC elected in January 2000, though its constitutional validity was questioned, was not challenged by counter-application and enjoyed de facto recognition. The acts of the respondents in amending the constitution and electing a new NEC were nullities as the conference was not properly constituted. The procedural objections raised by respondents were dismissed as lacking merit or not fatal.
