Procedural Posture

Judicial Review / Civil Application / Judgment on Merits After Opposed Motion

  1. 1 Whether the Minister responsible for the Public Service had the power to transfer/redeploy the applicant without involvement of the Public Service Commission
  2. 2 Whether the transfer amounted to a demotion or removal from office
  3. 3 Whether the applicant's right to be heard was violated

Ratio Decidendi

The Minister responsible for the Public Service acted within his statutory powers under the Public Service Act, 1995, in transferring the applicant, as this did not amount to a removal or demotion but a redeployment. The applicant retained her salary and other terms of service. The power to transfer does not require involvement of the Public Service Commission unless it is a removal or dismissal. The application for review and setting aside of the transfer must therefore fail.
