Ratio Decidendi

The High Court erred in holding that a civil marriage alone sufficed to apply common law to the deceased's estate without factual inquiry into abandonment of tribal custom. The authenticity and validity of the will were not properly addressed. The non-joinder of the Master and non-compliance with procedural rules were fatal. The matter must be remitted for proper ventilation of these issues, with the Master joined and affidavits supplemented.
