Ratio Decidendi

A letter of demand or notice is not a prerequisite to bringing a condonation application under section 77 of the Police Act. The appellant must first obtain condonation for late filing, after which notice can be served. The High Court erred in dismissing the application for lack of a letter of demand and in preemptively denying the appellant an opportunity to seek extension.
