Gerard Ralebitso was born during the subsistence of a valid marriage between Clementina and Tsebo Augustinus Ralebitso, making him legitimate and a member of the Ralebitso family. The Ntanyelo family, not being in loco parentis, could not validly negotiate bohali or a customary marriage for Gerard. Therefore, no valid customary marriage existed between Gerard and Sekhothali, and the right to bury Sekhothali rests with the first respondent (her father), not the applicant or the Ntanyelo family.
