The court exercised its discretion under Order 23 rule 1(1) Rules of Court 2012 and concluded that credible evidence showed the plaintiff company is controlled by a sole director ordinarily resident outside the jurisdiction and there is a real risk of inability to recover costs; accordingly it was just to order security for costs of RM100,000 to be deposited by the plaintiff by the specified date and to award costs in the cause.
