Procedural Posture

Civil Appeal From High Court Judicial Review Decisions / Determination on Consolidated Appeals (final Judgment)

  1. 1 Whether omission of the phrase in s.15(1) PCA 1959 (‘if the Board is satisfied that it is necessary that control and supervision be exercised over the registered person but that it is not necessary to detain him’) from the Police Supervision Order (PPP) renders the order fatally defective and invalid
  2. 2 Whether extrinsic affidavit evidence can cure an alleged procedural defect in the PPP
  3. 3 Whether PPP is required to follow a statutory/formal wording or form under the Act

Ratio Decidendi

The Court of Appeal held that omission of the verbatim statutory phrasing from the Police Supervision Orders did not render the orders invalid where the Board had in fact considered and been satisfied of the statutory preconditions under s.15(1) of the Prevention of Crime Act 1959; the PPPs were therefore not fatally defective, the High Court's certiorari orders were set aside and the appeals were allowed.
