All three conditions for res ipsa loquitur were satisfied: the pulling-away manoeuvre would not ordinarily cause contact if proper care taken, the tug and operation were under Defendant's sole control, and there was no unexplained absence of evidence; Defendant failed to rebut the resulting inference by proving a more probable non-negligent cause or that all due care was exercised; the master of the tug was negligent and Plaintiff is entitled to damages, but Plaintiff failed to prove full quantum; Court awards RM50,000 damages plus interest and orders Plaintiff to pay Defendant’s costs and reimburse expert fees due to reasonable Calderbank offers.
