Because Act 846 abolished the death penalty for kidnapping and replaced it with a 30–40 year imprisonment term, the Sessions Court now has competent jurisdiction under the Subordinate Courts Act and, pursuant to section 12 of the Schedule to the CJA, the High Court lawfully exercised its power to transfer the cases to the Sessions Court despite earlier PP consent under s177A CPC.
