Ratio Decidendi

The High Court held that, applying PJD Regency, the 36‑month completion period commenced from the identifiable booking fee payment (16.9.2017) because receipts established the payment as part of the first 10% deposit; the Tribunal correctly found vacant possession (acceptance of keys) in late 2021; unpleaded Ministerial exemptions could not be considered and therefore did not vitiate the Award; however, in JR No.139 the Tribunal breached natural justice by hearing before the last day to file a defence, so that Award was quashed by certiorari.
