Ratio Decidendi

The Speaker's decision to suspend the appellants indefinitely was not made in accordance with the Standing Rules or the Act, as the Speaker has no power to suspend members; such power is reserved for the House upon recommendation by the Committee on Privileges. Rule 124 cannot be invoked where the rules expressly provide for suspension. Section 21 of the Act does not oust the court's jurisdiction because the necessary jurisdictional facts were absent and the decision was not that of Parliament but of the Speaker. The suspension was thus unlawful, of no effect, and set aside.
