The estate of the deceased is to be administered and distributed according to the customary law of the Ovambo people, which follows matrilineal succession. The first respondent, not being related to the deceased by consanguinity, has no right to inherit the property. The transfer of the property into the first respondent's name was unlawful and is set aside. The property is to be transferred to the applicant, the lawful heir under customary law.
